Belarus' Ministry of Justice Reproaches Russia for Ignoring the Lawsuit on Oil Duties

Belarusian Ministry of Justice reproached the Russian side, a defendant in the CIS Economic Court to the claim for illegal levying of export duties on petroleum products supplied to Belarus, that it still had not provided its response on Belarus' statement of claim. The issue examination is scheduled for September 7. It is noted in the statement of Justice Ministry of Belarus.

«In its address, the Belarusian side has indicated concrete clauses of international agreements, violated by the Russian Federation by unilateral (without any notification of the Belarusian side) levying of customs duties on certain petroleum products from January 1, 2010. In accordance with universally recognized world practice and procedures of the Court, the respondent’s answer should be presented to the claimant’s application», stated in the ministry.

According to Justice Ministry representatives, the CIS Economic Court ordered the Russian side to present its opinion twice — on April 21 and May 19, 2010, but neither the Court nor the Belarusian side has been informed about the arguments of the defendant yet.

«Immediately after our Republic’s claim to the Court, Russian mass media voiced that Russia had real legal advantages in the dispute. It seems that there are so many «legal advantages», that they could not formulate and systematize them in five months after Belarus had turned to the Court «, noted in Belarusian Ministry.

As representatives of the Ministry of Justice reported, «in international law it is used to execute courts’ decisions, especially because of the EurAsEC Court is the main and the only judicial body of the Eurasian community, as well as of the Customs Union, actively promoted by the Russian side».

As Telegraf previously reported, the Ministry of Justice through the court calls for Russia to cancel export duties on oil products and Russian petrochemical raw materials supplied to Belarusian refineries. On March 25, the Ministry of Justice sent appropriate petition to the Economic Court of CIS, which serves as the EurAsEC Court and from July serves as the court of the Customs Union.
