Belarusian Citizen Wins a Case against Ukraine in the European Court

Belarusian citizen, Oleg Kamyshev, won a case against Ukraine in the European Court of Human Rights. The European Court recognized Ukraine guilty in violation of the right of liberty and personal security of the Belarusian, who had been illegally detained by Ukrainian authorities. It is reported by the Ukrainian Helsinki Human Rights Union.

Oleg Kamyshev is a disabled of the second group and he has spent almost three months in custody, waiting extradition to his homeland. The court noted that the Belarusian was deprived of liberty without any legal grounds.

The Ukrainian side did not even initiate a criminal case against Oleg Kamyshev. The only reason for the detention of Oleg Kamyzhev was Belarus’ demand to extradite him.

From the court’s decision it comes that it’s prohibited to keep somebody in custody, if there is no clear and accessible legislation, which stipulates the grounds and procedure for such detention. The European Court found that there is no such legislation in Ukraine.

The Ukrainian Helsinki Human Rights Union also noted the fact that only recently the Verkhovna Rada of Ukraine adopted changes to the Code of Criminal Procedure — which directly concern issues of extradition — waiting for the signature of the Ukrainian president.
