CIS Court Did Not Prohibit Russia to Charge Duties from Belarus

CIS Economic Court refused to satisfy the petition of Belarus to Russia on the imposition of a temporary ban to levy export duties on petroleum products supplied to Belarus. This decision was made on September 7 at session of the CIS Economic Court in Minsk.

The next session of the Economic Court will be held on October 7, 2010. By this time, the court suggested Russia and Belarus to reach mutually beneficial out-of-court resolution of the dispute, BelTA informs.

The Minister of Justice, Viktor Golovanov, in response to the court’s decision noted that conciliation was possible only with the consent of both parties. Belarus has not consented to out-of-court resolution of the dispute before they consider Belarusian petition on the imposition of a temporary ban for Russia’s levying export duties on petroleum products supplied to Belarus.

As Telegraf already reported, Russia offered Belarus to resolve out of court the dispute of levying import customs duties on oil products imported from Russia to Belarus. Such application was made on September 7 by the Russian side at the meeting of the CIS Economic Court, dedicated to the legality of Russia’s charging oil duties.

In its turn, the Belarusian side supported the intentions of their Russian counterparts to resolve the dispute out of court, but as a precondition for that, they proposed to consider a petition to impose a temporary ban to levy export duties on petroleum products supplied to Belarus.

According to the Minister of Justice of Belarus, Viktor Golovanov, Belarus has previously tried to solve the dispute out of court, however they have not achieve mutually beneficial solution. «During H1 of this year, the direct damage of Belarusian enterprises because of taxes levied by Russia amounted to $7 million», Viktor Golovanov noted.
