Lukashenko Abolishes the Licensing of 16 Activities

President of Belarus, Alexander Lukashenko, abolished compulsory licensing of 16 activities, seven of which include 59 component services. The president signed the decree №450 on September 1, 2010. The signing of this document should promote the liberalization of economic activity in the country.

In addition to the abolition of licensing of certain services, new decree provides the unification of two activities in one on another 13 activities, which licensing is preserved. This category of economic activity includes about 60 works and services.

As reported in the press service of Alexander Lukashenko, the decree was aimed at a comprehensive regulation of relations in the field of licensing and provided approval of clauses on licensing of certain activities. The clause consists of two parts. The first part presents general issues of licensing, the second — particularities of the licensing of certain activities.

Thus, according to the presidential decree, a license to provide telematics is no longer required (except telephony services on IP-protocol and IP-TV services).

It will be possible to produce original alcohol without a license

There also abolished licensing of retail trade, except alcohol and tobacco sale. Under the decree, there will not be required a license to produce original alcoholic beverages in cultural and ethnographic centers, national parks and reserves «in order to recreate the plenitude of Belarusian national traditions».

In addition, from the moment the decree entries into force there will be no need to obtain a license to use waste of 1st to 3rd classes of danger, waste neutralization in the process of research or development activities, as well as waste resulted by such work.

There will be no need in a license to perform work and services with precious stones, classified unfit for the manufacture of jewelry.

There will be no need in a license to product printed products using copiers, printers, plotters, digital duplicators. There will not be necessary to get a license to perform international road cargo transportation by a vehicle with permissible maximum weight, including the weight of the trailer (semitrailer), not exceeding 3.5 tons.

The decree on the abolition of licensing will be effective from January 1, 2011

Presidential decree enters into force on January 1, 2011. However, the decree stipulates that legal entities and individuals, as well as individual entrepreneurs have a right not to renew the licenses for the implementation of activities, which include only those components of activities, works and services, which licensing is abolished, in the period from the date of official publication of the decree until its entry into force.

They can operate basing on licenses issued before January 1, 2011, under the condition to follow requirements, provided by the decree, until their expiration.

Abolition of the requirements for licensing of certain activities and their component services, optimization of procedure and reduction of licensing procedures time, introduction of comprehensive regulation of relations in the sphere of licensing, stipulated by presidential decree, will reduce the administrative burden on business entities’ activity.
