President of Belarus, Alexander Lukashenko, signed a decree № 388 "On the order of state housing stock disposal". The document comes into force four months after its official publication and determines clear mechanism of compensated and uncompensated alienation of state housing, the press service of the head of state informs.
Moreover, the decree, adopted «for complex management of legal relations on disposal of state (Republican) housing stock», defines the mechanism of state housing transfer within republican property, as well as acquisition of residential premises into the property of the Republic of Belarus, reported in the presidential press service.
The document determines the competence of state bodies on disposal of residential premises managed by them, as well as residential premises, which are in operational or economic management of subordinated republican legal entities (which make part of them) or transferred for free use of non-state legal entities.
After the decree entries into force, sate institutions well be able to alienate residential premises to employees, registered as needed better housing conditions, and will sell them to such kind of citizens at assessed value (but not higher than the market value).
The decision on alienation of state-owned residential property to the citizens, not registered as needed better housing conditions, as well as to legal entities on compensated and uncompensated basis and residential premises sale at bidding will be made by the country’s president.
As of free transfer to communal ownership of residential premises, owned by the Republic of Belarus and which are in operational management of the National Bank, presidential Administration, Office of Presidential Affairs, National Academy of Sciences, other state bodies (state organizations) under the president and General Prosecutor’s Office, as well as acquisition of residential premises into the state ownership at the expense of national budget or for free, then the decision about it will be taken by the government with the approval of the president.
The government will be entitled to transfer residential premises within Republican property, alienate public housing in other cases, defined by the decree.
Detailed decision-making mechanism for the sale of residential premises is fixed in the Statute on the procedure and conditions for the sale of residential premises of the national housing stock, approved by the decree.
